Financial policy

  • If you elect to modify your requested lab(s) after submitting payment you will be assessed a ten ($10) dollar administrative fee.  This lab requisition adjustment must be made PRIOR to having your lab appointment and no additional requests can be made after you've had your blood drawn.

  • Order Cancellations:

  • Effective 4/1/2025 --- all sales are final.  Whether or not you attempted to or actually did have your blood work obtained, all transactions are final.  However, if you want to add an additional item(s) to an existing order you may do so prior to attempting to obtain blood work for that said order. 

  • Effective 4/1/2025 --- You have approximately 30 days from receiving your requisition form to obtain your bloodwork.  After the initial 30 day period LabCorp deletes the order and it is no longer valid.  Refunds will not be issued to those who did not obtain their blood work within 30 days of requisition submission. 

 

Medical acknowledgement

 

  • Your lab results are NOT used to treat, diagnose, assess, cure, monitor, or remediate any known or unknown health findings or health status and any lab findings, whether normal or abnormal, are solely the responsibility of the customer ("buyer," "consumer") to be further evaluated by a medical professional

  • We, Prime Performance Partners, PLLC ("The Clinic on Main"), are not responsible for identifying, acknowledging, treating, assessing, or diagnosing any abnormal findings, if present.  Such information is provided for informational purposes and for your general interest only. Such information is not intended to be a substitute for medical advice, diagnosis or treatment provided by a doctor or other qualified healthcare professional. You should not use the information contained herein for diagnosing or treating a health condition, problem or disease. Please consult with your doctor or medical healthcare professional to see if any information discussed at this Website is appropriate for you. 

  • Electronic communications are not an effective means to transmit information regarding health status, especially that of urgent nature, and The Clinic on Main makes no guarantee of any particular response time to any inquiries that you may make. Accordingly, if you are experiencing a medical emergency, a possible health concern, or have any inquiry it is solely your responsibility to seek medical attention immediately. 

 

Limitation of liability 

 

  • As partial consideration for your access to our Services and use of Content, you agree that in no event will The Clinic on Main, its medical advisers, officers, directors, employees or its contractors, suppliers, content-providers and other similar entities, representatives and agents of each of the foregoing (collectively, our "Contractors"), be liable to you, your Company, or any third party for any losses or damages, alleged under any legal theory, arising out of or in connection with: (a) your use of, or reliance on, the Services or the Content; (b) our performance of or failure to perform our obligations in connection with these Terms; (c) the defamatory, offensive or illegal conduct of other users of the Services or of third parties; or (d) your purchase or use of any goods or services provided by third parties.

  • Under no circumstances will The Clinic on Main or our Contractors be liable to you, your Company, or any third party for any indirect, consequential, incidental, punitive, special, or similar damages or costs (including, but not limited to, lost profits or data, loss of goodwill, loss of or damage to property, loss of use, business interruption and claims of third parties) arising out of or in connection with these Terms or the use of the Services or the Content, or the transmission of information to or from the Services over the Internet, even if we were advised, knew, or should have known of the possibility of such damages or costs. In a jurisdiction that does not allow the exclusion or limitation of liability for certain damages, the liability of The Clinic on Main and the Contractors will be limited in accordance with these Terms to the extent permitted by law.

  • Without limiting any of the foregoing, if The Clinic on Main or any of the Contractors is found liable to you or to any third party as a result of any claims or other matters arising under or in connection with these Terms, the Services, or your use of the Services, the maximum liability for all such claims and other matters will not exceed $100 in any calendar year.

 

Indemnification

 

  • You agree to indemnify, defend, and hold harmless Prime Performance Partners, PLLC ("The Clinic on Main"), its managers, members, employees, agents, licensors and suppliers ("Contractors") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees and court costs, resulting from any violation of these Terms and Conditions of Use (including, but not limited to, negligent or wrongful conduct) by you. The Clinic on Main reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with The Clinic on Main in asserting any available defenses. 

 

Waiver

 

  • You further agree and understand that The Clinic on Main provides an administrative service. As such, The Clinic on Main does not make any representations or warranties as to the results of any lab tests or the efficacy of any course of treatment. All responsibility for the well-being and care of your patient is borne by you, the ordering patient. You hereby represent to The Clinic on Main that you accept all responsibility for any acts or omissions resulting therefrom. You hereby agree to defend and hold The Clinic on Main harmless for your errors and omissions related thereto. You also agree to indemnify, defend and hold The Clinic on Main harmless for any act or omissions resulting from your negligence in following the terms of this agreement or in the treatment of patients. You represent that you have read and agreed to the The Clinic on Main's Privacy Agreement. You understand that service is not available in NY, NJ, or RI. You understand that The Clinic on Main does not accept insurance or file insurance claims.

  • You understand that results of this testing and all informational material is used for informational purposes and not a substitute for specific medical care. By accepting these Terms for referral for testing and/or screening services, you hereby certify that you have read this entire agreement that you understand and agree to all the terms and conditions. You knowingly and voluntarily use this acceptance as your consent for initiating a relationship with The Clinic on Main for appropriate laboratory screening. By accepting these Terms for referral for testing and/or screening services, you hereby certify that you have read this entire agreement that you understand and agree to all the terms and conditions. You knowingly and voluntarily use this acceptance as your consent for initiating a relationship with Discounted Labs for appropriate laboratory screening.

  • BY ACCESSING AND USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF USE.

 

Governing law

 

  • These Terms and Conditions of Use and your use of the Website or the Content shall be governed by the laws of the State of New Hampshire, without regard to its conflict of laws provisions. Any legal action or proceeding relating to this Website shall be brought exclusively in a federal or state court of competent jurisdiction in Rockingham County, New Hampshire. 

 

Waiver of jury trial

 

  • YOU HEREBY KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL IN ANY ACTIONS, SUITS OR PROCEEDINGS ARISING OUT OF OR RELATING TO THESE TERMS AND THE MATTERS CONTEMPLATED HEREBY.
